Fusion5 Privacy Policy

The following sets out our policies for managing your personal information and is referred to as our Privacy Policy. In this Privacy Policy, “we” and “us” refers to Fusion5 and “you” refers to any individual about whom we collect personal information.

If you do not agree with this policy, do not access or use our Services or interact with any other aspect of our business. Your continued use or engagement with Fusion5 or our resources shows you consent to our collection, use and disclosure of personal information in the manner set out in this policy below.

Regulatory compliance

We comply with both the Australian Privacy Act 1988 and the New Zealand Privacy Act 2020 and adhere to the Information Privacy Principles for our Australian and New Zealand websites respectively.

Specifically, Fusion5 will comply with the mandatory breach notification requirements of these acts.

Collection of personal information from customers

In instances where Fusion5 is providing products or services under the direction of another entity that is the data controller—responsible for determining the purposes and means of processing personal data—the handling of your personal information is governed by the privacy policy of that data controller. If you have concerns or inquiries about how your personal information is being processed in these scenarios, you must contact the data controller directly in the first instance. Fusion5 acts as a data processor on behalf of the data controller entities, and our processing of your personal data is conducted according to their instructions and within the bounds of our contractual obligations to them.

In these instances where Fusion5 is only the data processor (and not the data controller), any personal information collected by, or otherwise becomes possessed by Fusion5, will be used solely for the purposes for which it was collected and consented to, by you, to the data controller. We adhere strictly to the principle of purpose limitation, ensuring that your data is not repurposed for marketing or any other unrelated uses without your explicit consent.

Fusion5 does not use personal data collected from our customers for our own marketing purposes.

Our use of your Personal information

Your use of our websites and services involves the collection by Fusion5 of personal information about you.

For example, when you visit our website, we may collect:

  • Your registration details, including your email address and phone number
  • Other identifying information, such as your IP address and browser type
  • Personal information provided by you for access to additional information, resources or web services

We automatically receive certain types of information whenever you interact with our websites including your IP address, type of browser or operating system you use.

Giving you control of marketing communications

Fusion5 may use or disclose your personal information to inform you about our services, promotions, and events. When browsing our website, we may provide the follow information to a third party for market research purposes and to provide more relevant information to you:

  • Your device type, device identification data, browser type, IP address, cookies and pages you have accessed on our websites
  • First and last name
  • Email address
  • The name of your employer, your business role and title, business network, business experience, business interests, connection data
  • Social media URL
  • Localisation data

Any marketing email from Fusion5 provides you with access to your preference centre to manage your own opt-in interests and to specify the marketing messages and marketing you receive.

We don’t like spam and want to ensure you have control over what you receive.

Security and control of your personal information

Fusion5 stores all personally identifiable information collected in a controlled, secure environment, protected from unauthorised access, use or disclosure. While Fusion5 operates primarily within Australia and New Zealand, we leverage the skills and technologies available around the globe. We have people, clients, service providers, and cloud services in many countries, and it is likely that your personal information that Fusion5 uses for its own internal business purposes will be stored, or accessed by people, outside of Australia and New Zealand.

Unless we have your consent, or an exception under the Australian Privacy Principles applies, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient complies with the applicable Australian and New Zealand Privacy Laws in relation to your personal information. All employees receive training on their obligations and agree to abide by this policy.

Use and disclosure of personal information

Fusion5 does not disclose personal information except to complete a transaction at your request, for example, to data processing companies, banks and payment gateways.

Wherever possible, Fusion5 will anonymise personal data to protect privacy.

We will disclose your personal information without notice only in exceptional circumstances.  We may be required to do so by certified Compliance with Enforcement Requests, applicable laws, to protect from illegal activities or to enforce our rights. We will provide personal information as part of an emergency response which we believe in good faith is required to assist in preventing the death or serious bodily injury of any person.

Fusion5 will never sell, rent or lease “customer lists” or information to third parties. We may use or distribute personal information for bona fide market research purposes. However, we will always ensure that personal identifiers are removed prior to the use of, or distribution of, such information.

Fusion5 may use personal information in pursuit of its business objectives, such as:

  • Testimonials or references, with your prior consent
  • Where you share information openly over Social Media, such as LinkedIn or Blog comments
  • Improving Fusion5 products/services
  • For a known business purpose, such as raising a support request with a third party Partner such as Ivanti, 4me, Microsoft, AWS, Oracle, etc in the course of operating our business
  • Collaboration, for example, to create a better user community for the Products we implement

Use and disclosure of personal information to You

You may make a request to access the personal information held about you, and, as long as we have such information, we will provide it. You may also ask us to correct personal information held about you that is not accurate or up-to-date.

You have the “right to be forgotten” by Fusion5, so long as that does not interfere with a legal, contractual or support obligation of Fusion5. We cannot delete such data.

Deal with Fusion5 anonymously

On request, Fusion5 can provide individuals with the opportunity of remaining anonymous or using a pseudonym in their dealings with us where it is lawful and practicable. Generally, it is not practicable for Fusion5 to deal with individuals anonymously or pseudonymously on an ongoing basis. If we do not collect personal information about you, you may be unable to utilise our services or participate in our events, programs or activities we manage or deliver. Fusion5 may need to identify you in order for you to exercise your rights associated with your personal information.

How long we keep your personal information

Our retention of personal information depends upon the purpose for which it was collected.

Marketing data will be deleted when Fusion5 deem it irrelevant, after two years of inactivity or following a verified request.

Contract and support data will be retained for commercial, support and warranty purposes in accordance with Fusion5’s Business needs. This may be up to seven (7) years past the last transaction.

Data that has been anonymised may be kept for an indefinite period and at the discretion of Fusion5.

How we interact with you via the internet

You may visit our websites without identifying yourself by utilising the tracking prevention feature in your browser. If you identify yourself (for example, not utilising the tracking prevention feature or by providing your contact details in an enquiry), Fusion5 will manage any personal information obtained about you in accordance with this Privacy Policy.

Fusion5's website may use "cookies" to track usage to improve your web experience.

Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer.

Information links from Fusion5's websites

The Fusion5 websites may contain links to other websites. Please be aware that we are not responsible for the privacy practices of other sites you choose to visit. If you provide any information directly to parties other than us (even if those sites are showing the Fusion5 brand), different rules may apply to the use or disclosure of the personal information disclosed.

We encourage you to investigate and ask questions before disclosing your personal information to third parties.

Email

Emails and any attachments sent from Fusion5 are confidential and intended exclusively for the person to whom the email is addressed.

If you are not the intended recipient, do not read, copy, disclose or use the contents in any way. Please notify us immediately by return email and destroy the email and all attachments.

Fusion5 accepts no responsibility for any alterations made to sent emails (or accompanying documents) after initial transmission. The opinions expressed are not necessarily those of Fusion5.

Changes to Fusion5's policy

Fusion5 may, at our discretion, update or revise this Privacy Policy at any time. Any changes will take effect immediately once they are posted on our websites. It is your responsibility to check our Privacy Policy regularly for any modifications or updates. Your continued use of our services after any changes have been posted on the Fusion5 websites indicates your acceptance of those changes.

It takes consideration of the European Union General Data Protection Legislation (GDPR) as well as guidelines from the Office of the Australian Information Commissioner and the Office of the New Zealand Privacy Commissioner.

Changes to Fusion5's policy

You may contact Fusion5 at any time to exercise your rights under this policy, or if you have any questions or concerns about this policy or about the way in which your personal information has been handled.

In most cases, we will investigate and respond to a complaint within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know.
